PRIVACY POLICY (GDPR)

 

Basic Provisions

The data controller under Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is POPONA s. r. o. ., ID No.:21380422, with its registered office at Františka Diviše 1427/54L, 10400, Praha 10 (hereinafter: "controller").

Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be directly or indirectly identified, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

The controller has not appointed a data protection officer.

Sources and Categories of Processed Personal Data

The controller processes personal data that you have provided to it or that the controller has obtained based on the fulfillment of your order.

The controller processes your identification and contact details and data necessary for fulfilling the contract.

Legal Basis and Purpose of Processing Personal Data

The legal basis for processing personal data is:

  • Performance of the contract between you and the controller according to Article 6(1)(b) GDPR,
  • Legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(f) GDPR,
  • Your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(a) GDPR in connection with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the case that no goods or services were ordered.

The purpose of processing personal data is:

  • Handling your order and the performance of rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data necessary for successful processing of the order (name and address, contact) is required. Providing personal data is a necessary condition for concluding and fulfilling the contract. Without providing personal data, the contract cannot be concluded or fulfilled by the controller,
  • Sending commercial communications and conducting other marketing activities.

Data Retention Period

The controller retains personal data:

  • For the period necessary to perform rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 10 years from the end of the contractual relationship).
  • Until the consent to processing personal data for marketing purposes is withdrawn, but no longer than 15 years.

After the retention period has expired, the controller will delete personal data.

Recipients of Personal Data (Subcontractors of the Controller)

Recipients of personal data are:

  • Persons involved in the delivery of goods/services/processing payments based on the contract,
  • Providers of e-shop operation services and other services related to the operation of the e-shop,
  • Providers of marketing services.

The controller intends to transfer personal data to a third country (a country outside the EU) or an international organization. Recipients of personal data in third countries include mailing service providers and cloud service providers.

Your Rights

Under the conditions set out in the GDPR, you have:

  • The right to access your personal data according to Article 15 GDPR,
  • The right to rectification of personal data according to Article 16 GDPR, or restriction of processing according to Article 18 GDPR,
  • The right to erasure of personal data according to Article 17 GDPR,
  • The right to object to processing according to Article 21 GDPR,
  • The right to data portability according to Article 20 GDPR,
  • The right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these conditions.

You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your personal data protection rights have been violated.

Data Security Conditions

The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

The controller has implemented technical measures to secure data storage and physical storage of personal data, including: highly secure passwords, antivirus programs, encryption using HTTPS certificates.

The controller declares that only authorized persons have access to personal data.

Final Provisions

By submitting an order through the online order form, you confirm that you are familiar with the personal data protection terms and that you accept them in their entirety.

The controller is entitled to amend these terms. The new version of the personal data protection terms will be published on its website and will also be sent to you via the email address you provided to the controller.
